Terms and Conditions of Use
Contipay Donate
Effective Date: 17/9/2025
These Terms and Conditions (“Terms”) govern your use of the Contipay Donate platform (“the Platform”), operated by Contipay Donate (“we,” “our,” or “us”). By registering, creating a campaign, or making a donation, you (“User,” “Campaigner,” or “Donor”) agree to these Terms.
1. Purpose of the Platform
Contipay Donate provides an online platform that enables Users to:
Launch fundraising campaigns for themselves or on behalf of others in financial need; and
Facilitate donations through secure payment processing channels.
Contipay Donate acts as a platform and payment processor only. It is not a charity, trustee, or financial institution.
2. User Responsibilities
Users must provide accurate and truthful information when registering or creating a campaign.
Users are strictly prohibited from:
Launching unauthorized or false campaigns;
Using another person’s details without their consent;
Engaging in fraud, scams, money laundering, or unlawful activity.
3. KYC and Due Diligence
Campaign Organizers (and, in some cases, Donors) may be required to undergo Know Your Customer (KYC) checks.
KYC may include identity verification, proof of address, and other information as required.
After successful KYC, Contipay Donate may mark a campaign as legitimate to the extent of the due diligence carried out.
This does not make Contipay Donate liable for false, misleading, or fraudulent campaigns created by Users.
4. Liability Limitation
Contipay Donate’s liability is limited only to the extent of its reasonable KYC due diligence.
We are not liable for:
False or fraudulent campaigns,
Unauthorized use of another person’s details,
Campaigns that fail to reach their goals or fail to deliver outcomes.
5. Campaign Approval and Restrictions
Contipay Donate reserves the sole right to approve, reject, suspend, or remove any campaign.
Such actions shall not be considered discriminatory.
Campaigns involving political parties, political fundraising, or electioneering are strictly prohibited.
6. Donor Safety
Donors contribute voluntarily and acknowledge that donations are non-refundable, except as required by law.
While KYC checks are performed, Donors accept that Contipay Donate cannot guarantee how campaign funds will be used.
Donors are encouraged to exercise discretion before making contributions.
7. Fraudulent Campaigns and Consequences
If a campaign is found to be fraudulent, Contipay Donate may:
Suspend or permanently ban the User,
Withhold or return funds,
Report the matter to law enforcement,
Cooperate in investigations to protect Donors.
The Campaign Organizer will be legally responsible for refunding Donors and may face civil and criminal action.
8. Anti-Money Laundering (AML) Compliance
Contipay Donate complies with Zimbabwean and international AML obligations.
Suspicious transactions will be investigated and reported to regulators.
Users engaging in money laundering risk:
Immediate account suspension,
Freezing of funds,
Reporting to authorities,
Criminal prosecution.
9. Prohibited Uses
Users may not use the Platform for:
Fraudulent, misleading, or deceptive activities,
Political campaigns or election fundraising,
Terrorist financing or organized crime,
Money laundering or concealment of funds,
Human trafficking or exploitation,
Pornography, sexual exploitation, or obscene materials,
Drugs, contraband, or weapons,
Gambling, pyramid schemes, or Ponzi schemes,
Hate speech, violence, or discriminatory content,
Uploading false documents or falsifying KYC information,
Any activity that violates Zimbabwean or international law.
10. Privacy and Data Protection
Contipay Donate collects and processes User data in line with its Privacy Policy, available on the Platform.
By using the Platform, Users consent to the collection, storage, and use of their data as described in the Privacy Policy.
Users are responsible for keeping their account login details confidential.
Contipay Donate shall not be liable for any unauthorized access or data breach not directly caused by its own systems.
11. Platform Rights
Contipay Donate reserves the right to:
Suspend or terminate any User account that breaches these Terms,
Freeze transactions pending investigation,
Modify or discontinue the Platform at any time without liability.
12. Indemnity
Users agree to fully indemnify, defend, and hold harmless Contipay Donate, its directors, officers, employees, agents, affiliates, successors, and assigns (collectively, “Indemnified Parties”) from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of or related to:
Fraudulent or Unauthorized Campaigns:
Launching campaigns without the consent of the beneficiary.
Submitting false, misleading, or deceptive information during campaign creation.
Using another person’s identity, information, or intellectual property without authorization.
Misuse of the Platform:
Engaging in activities that violate these Terms or any applicable law.
Attempting to disrupt, hack, or otherwise interfere with the Platform’s systems, security, or functionality.
Misappropriation or misuse of funds raised through campaigns.
Violation of Laws or Regulations:
Breaches of anti-money laundering (AML), counter-terrorism financing (CFT), or other regulatory requirements.
Conduct that results in fines, penalties, or legal actions against Contipay Donate.
Participation in any prohibited activity outlined in the Terms, including but not limited to political campaigns, gambling schemes, or illegal trade.
Third-Party Claims:
Any claim made by a third party arising from a User’s campaign, content, or activity on the Platform.
Claims related to defamation, invasion of privacy, intellectual property infringement, or violation of any contractual or statutory rights.
General Legal Responsibility:
Any costs, damages, or losses incurred by Contipay Donate in defending against claims arising from the User’s actions, whether intentional or negligent.
The obligations under this indemnity survive the termination or suspension of the User’s account and remain enforceable even after the User stops using the Platform.
Limitation of Liability for Donations
Contipay Donate acts solely as a platform and payment processor and does not control or manage the campaigns created by Users.
Except in exceptional circumstances, Contipay Donate shall not be liable for any loss, misappropriation, or misuse of donated funds, nor for any failure of a campaign to achieve its goals or deliver on its stated purpose.
Exceptional circumstances are limited to situations where Contipay Donate has directly caused the loss or mismanagement of funds due to gross negligence or willful misconduct.
In such cases, Contipay Donate’s maximum liability shall be limited to the amount of funds directly lost as a result of its gross negligence or willful misconduct.
Users and Donors acknowledge and agree that this limitation reflects a reasonable allocation of risk given the platform’s role and the nature of third-party campaigns.
13. Governing Law
These Terms shall be governed by the laws of Zimbabwe, and any disputes shall be subject to the jurisdiction of Zimbabwean courts.
14. Amendments
Contipay Donate may amend these Terms from time to time. Updates will be posted with a revised “Last Updated” date. Continued use of the Platform constitutes acceptance of the revised Terms.
